What not to do when Pulled over for Driving while Intoxicated

If you’re pulled over on suspicion of a DUI, then there are some important things you need to know in how to handle the stop. Depending on how well you conduct yourself, your lawyer may have an easier time of having your case dismissed. Here are important things to keep in mind if you’re pulled over by a cop for drunk driving.

1) DO NOT TAKE FIELD SOBRIETY TESTS (FST)

Firstly, all field sobriety tests (roadside tests) are voluntary. These tests include the horizontal gaze test, the breath test, and others such as walking in a straight line. There is no legal obligation to take these tests, and it’s in your best interest not to. You should decline to take any of these tests. If the police officer says that you face arrest if you don’t submit to the tests, demand to speak with an attorney. At this point, you’ll probably be arrested anyway.

2) SAY AS LITTLE AS POSSIBLE WITHOUT BEING RUDE – CONTACT AN ATTORNEY ASAP

Secondly, do not admit that you’ve been drinking. In fact, say as little as possible. Every word that comes out of your mouth, and every test you take are only helping the police officer build his evidence against you, which isn’t a good thing. Therefore, it’s in your best interests to reveal as little as possible. Just ask to speak to an attorney. Always, always remember to remain polite and respectful to the officer. You don’t want to provoke them in any way. After all, why make things harder on yourself?

3) YOU’RE REQUIRED TO SUBMIT TO CHEMICAL BLOOD ALCOHOL CONTENT (BAC) TESTS

If you’re arrested and hauled down to the station, the name of the game has changed. Whereas while you were still on the road you were allowed to refuse to take field sobriety tests, the same can no longer be said of blood alcohol content tests. Chemical blood alcohol content tests are required under the law. This means you can’t refuse to take one. If you do, your penalty may be even higher if you’re unfortunate enough to end up with a conviction on your record.
